A Texas accident report, also known as a Texas Peace Officer’s Crash Report (CR-3), is a document that records the details of a motor vehicle crash that occurred on public roadways and the state highway system. A Texas accident report may include information such as the date, time, and location of the crash, the names and addresses of the drivers and passengers involved, the vehicle identification numbers (VINs) and license plate numbers of the vehicles involved, the insurance information of the drivers, the weather and road conditions at the time of the crash, the description and diagram of the crash, the injuries and damages sustained, the contributing factors and causes of the crash, the citations issued, and the opinions and remarks of the investigating officer.
A car accident may stay on your insurance record in Texas for up to three years, depending on the severity of the accident and the type of insurance policy you have. If you are at fault for the accident, your insurance company may increase your premium rates or even cancel your policy. If you are not at fault for the accident, your insurance company may not raise your rates, but the accident may still appear on your record. Some insurance companies may offer accident forgiveness programs that can prevent your rates from going up after your first or second accident.
If your report contains inaccurate information, you may request a correction or amendment from the law enforcement agency that filed the report. You may need to provide evidence or documentation to support your request, such as witness statements, photographs, medical records, or repair estimates. The law enforcement agency may review your request and decide whether to make the correction or amendment. If the law enforcement agency denies your request, you may appeal the decision to the Texas Department of Transportation (TxDOT), which is the custodian of crash records for the state of Texas.
If you are involved in a motor vehicle crash that results in injury or death, or when damage to property or vehicles is more than $1,000, you have to file an accident report in Texas within 10 days of the crash, unless a law enforcement officer has already done so. You can file an accident report by using the Driver’s Crash Report (Form CR-2), also known as a “Blue form”, which is available online or at any police station. You have to mail or deliver the completed form to the law enforcement agency that has jurisdiction over the location of the crash. You do not have to send the form to TxDOT, as they no longer retain or host the CR-2 forms.
