Are accident reports public record in Texas?

In Texas, car accident reports are managed by the Texas Department of Transportation (TxDOT) and are not publicly available for online viewing due to their confidential nature. However, individuals involved in the accident, their representatives, and other eligible parties can obtain a copy of a Texas Peace Officer's Crash Report (CR-3) through the TxDOT's Crash Report Online Purchase System. There is a minimal fee for this service, and the reports are delivered via email following the purchase. For comprehensive guidance, it's recommended to refer directly to TxDOT's procedures and regulations regarding crash report records.

How to Read a Texas Crash Report?

Reading a Texas Crash Report requires understanding the numerical codes and specific fields used. These reports, also known as Texas Peace Officer’s Crash Reports (CR-3), include details such as the accident conditions, the total number of units involved, identification and location of the crash, vehicle and driver information, injury severity, safety equipment usage, and vehicle damage ratings. Injury severity is indicated by codes like 'A' for serious injuries, 'B' for non-incapacitating injuries, and 'K' for fatalities within 30 days of the crash.

Why Do You Need Your Texas Crash Report?

A Texas Crash Report is essential for several reasons. It provides detailed information about the crash, which can be crucial for insurance claims and legal proceedings. The report includes a narrative of the accident, identifies witnesses, and contains evidence like photographs and citations issued, all of which are valuable during the claims process or any disputes that may arise from the accident.

How Long Before your Texas Accident Report is Available?

In Texas, law enforcement officers are required to submit crash reports to the Texas Department of Transportation (TxDOT) within ten days of investigating a motor vehicle crash that results in injury, death, or property damage of $1,000 or more. These reports are then retained for a period of 10 years plus the current year. Although the reports are confidential, individuals can purchase a copy of the CR-3 form using the TxDOT's Crash Report Online Purchase System, and they will receive the report via email after the purchase6.
