A Texas accident report, also known as a CR-3 form, is a document that records the details of a motor vehicle crash that occurred on a public roadway or state highway system. The report includes information such as the date, time, and location of the crash, the names and addresses of the drivers and passengers involved, the vehicle descriptions and license plate numbers, the insurance information, the weather and road conditions, the contributing factors and causes of the crash, the injuries and damages sustained, the citations issued, and the diagrams and narratives of the crash. The report is filed by the law enforcement officer who investigated the crash, or by the driver if the crash was not investigated by an officer.

How long does a car accident stay on your insurance record in Texas?

A car accident can affect your insurance record in Texas for three to five years, depending on the severity of the crash and the insurance company’s policies. If you were at fault for the accident, or if the accident resulted in injuries or fatalities, it will likely stay on your record longer than a minor or no-fault accident. During this time, the accident may increase your insurance rates, as you will be considered a higher-risk driver by the insurance company. However, the exact amount and duration of the rate increase will vary depending on your driving history, the type of coverage you have, and the insurance company’s guidelines.

What If My Report Contains Inaccurate Information?

You will need to provide proof of the error, such as a witness statement, a photo, or a receipt, and submit a written request to the agency. The agency will review your request and determine whether to make the correction or amendment. If the agency agrees to make the change, they will notify you and the Texas Department of Transportation (TxDOT), which maintains the crash records for the state. If the agency denies your request, you may appeal the decision to the TxDOT.
